TERMS OF USE

Introduction

The terms of use for dref websites and any smartphone apps (Sites) include these terms, the eBoutique Terms, Shipping Information, our Privacy Policy, and any other terms and conditions that appear in or are linked to or from the Sites (Terms). These Terms govern your use of, and access to, the Sites.

1 – Content

The Sites and their content are subject to copyright and other intellectual property rights. These rights are owned by dref and its Australian and international related bodies corporate, or in the case of some material, a third party.
You must not reproduce, transmit (including broadcast), communicate, adapt, distribute, sell, modify, publish, or otherwise use any material on a Site, including audio and video excerpts, except as permitted by statute or with our prior consent.

Our Sites may include registered trademarks and other marks protected by law. You may not use our trademarks without our consent.

The Sites may contain links to third-party sites. These links are provided solely for your convenience and do not indicate, expressly or impliedly, any endorsement by us of the sites or the information, products, or services provided at those sites. You access those sites and use the information, products, and services made available at those sites at your own risk.

Some products or services offered for sale or advertised, and information provided via the Sites, may be from third parties and not necessarily dref. We may receive licence fees or commissions from third parties for products or services displayed or made available on the Sites or accessible through a link on the Sites. You acknowledge and consent to us receiving such fees.

2 – Use of the Sites

You must not:

  • Use the Sites (including any of dref’s social media sites) for any activities, or post or transmit to or via the Sites any information or materials, which:
    • Breaches any laws or regulations, infringes a third party’s rights or privacy, or contravenes applicable standards or codes.
    • Interferes with other users, defames, harasses, threatens, bullies, or offends any person, or inhibits any other user from using the Sites.
    • Is obscene, indecent, discriminatory, inflammatory, or pornographic or could give rise to civil or criminal proceedings.
  • Use the Sites to send unsolicited commercial or bulk electronic messages.
  • Make any fraudulent or speculative enquiries, reservations, or requests using the Sites.
  • Provide false information when registering or changing your registration details.
  • Tamper with, hinder the operation of, or make unauthorised modifications to the Sites.
  • Knowingly transmit any virus or other disabling feature to or via the Sites.
  • Attempt any of the above acts or permit another person to do so.

3 – Social Media

dref uses a number of social media sites (e.g., Twitter, YouTube, Facebook, Instagram, and Pinterest); these may change over time. We reserve the right to cease any such sites at our discretion. Our Sites may also include social media functions, including user reviews, ratings, forums, and the ability to interact with other users.

Third-party social media sites are governed by their own terms of use.

dref does not necessarily endorse, support, sanction, encourage, verify, or agree with any comments, opinions, or statements posted by users. Any information or material placed online by users, including advice or opinions, is the responsibility of those users and does not necessarily represent our views.

Users must not post or upload any comment, content, or link to the Sites or dref’s social media sites which does not comply with these Terms, including if it is defamatory, harassing, bullying, indecent, or inflammatory.

dref may moderate user-posted content and remove any content deemed inappropriate. While we review content regularly, inappropriate content may be viewable before removal. dref is not obliged to inform users when content has been moderated or removed.

Where you submit content to a Site, including as part of a competition or promotion, you warrant that:

  • You have permission from any person appearing in the content to submit it and for their image or likeness to be used in accordance with these Terms and our Privacy Policy
  • You have the right to submit the content (including copyright), the content is your original creation, and you irrevocably consent to any act or omission which might infringe your moral rights

dref may copy, reproduce, publish, display, alter, distort, or use user-submitted content for any purpose, including future promotions or campaigns, across any media.

dref does not accept responsibility for content downloaded from the Sites, nor for third-party interactions with submitted content.

Personal information provided may be used by dref to conduct campaigns, research, and marketing activities, and will otherwise be used in accordance with dref’s Privacy Policy.

Cookies are used to capture information when your device accesses online content. dref’s Privacy Policy outlines cookie usage. Disabling cookies may limit your experience of the Sites.

dref makes no representations or warranties regarding the operation of the Sites or the content provided, except as required under applicable laws.

Neither dref, nor its affiliates, directors, officers, employees, agents, contractors, successors, or assigns, are liable for damages arising from use of the Sites or linked sites, including direct, indirect, consequential, or punitive damages.

You assume all risk in using the Sites. By continuing to access our Sites, you agree to these Terms and applicable laws, at your own risk.

The Sites and their contents are provided “as is”; we cannot guarantee they will always be available or free of errors or viruses.

Updates and Termination

dref may vary these Terms at any time. By using the Sites, you consent to any variations. It is your responsibility to check these Terms regularly.

We may suspend or terminate access to the Sites for any user at our discretion, including for breaches of these Terms.

dref may disclose information about users to investigate alleged breaches of these Terms or applicable laws, and may pursue legal action, including injunctive relief.

These Terms are governed by the laws of Victoria, Australia. Disputes submit to the non-exclusive jurisdiction of Victorian courts, except for injunctive relief sought by dref.

The Sites may be accessed overseas. dref makes no representation that the Sites comply with laws outside Australia. Accessing Sites from outside Australia is at your own risk.

TERMS & CONDITIONS – eBoutique

These terms form a contract between the customer and dref, applying to the ordering, purchase, and delivery of Items from our websites, as amended from time to time. These Terms include important information about ordering, processing, delivery, and limitations of liability. Additional terms may apply, such as Shipping Information, Returns Policy, and Privacy Policy.

Definitions

  • Agent – a third-party delivery company determined by dref, e.g., DHL Express or TNT
  • Business Day – a day trading banks are open in Melbourne, Australia
  • Delivery Address – the address specified for delivery of Items
  • Delivery Fee – fee charged for delivery of Items; some shipping may be free
  • Gift Voucher – an online eBoutique gift voucher
  • Items – products offered for sale on the Site
  • Law – statutes, regulations, government rules, and legally recognised customs or policies
  • Order – request to purchase Items under these Terms
  • Personal Information – as defined in the Privacy Act 1988 (Cth)
  • Price – purchase price of each Item, including applicable taxes or duties
  • Privacy Policy – the dref Privacy Policy
  • Returns Policy – the dref Returns Policy
  • Site – www.dref.com.au or any other websites or apps maintained by or for dref
  • We, Us, Our – dref, including Australian and international related bodies corporate
  • You, Your – purchaser of Items under these Terms

Orders

Submitting an Order constitutes an offer to purchase Items for the Price (plus any Delivery Fee). Orders are for personal, non-commercial use only. Quantity restrictions may apply. You must provide accurate personal details, including consent to provide recipient details for gifts.

We may restrict the quantity of Items purchased per Order, per time period, per person, or per address.

dref is not liable for delays caused by inaccurate or incomplete details. You may order if aged 16+ with a valid email and phone number.

Once submitted, Orders cannot be cancelled or altered unless agreed by dref. Items can be returned under the Returns Policy.

Availability, Price, and Payment

  • Availability: Items may be out of stock or unavailable; refunds will be issued for unfulfilled Items.
  • Price: dref reserves the right to change Prices without notice. Orders submitted at a specific Price are protected unless affected by a pricing error.
  • Payment: Accepted methods include credit card or PayPal. Payment must clear before dispatch. Payment attempts must not involve fraudulent conduct.
  • Lay-by is not available.

Delivery uses third-party Agents. Delivery times are estimates; dref is not liable for delays. You may appoint a representative to accept delivery. Proof of identity may be required.

Cancellations and Returns

Orders cannot be cancelled unless agreed by dref. Items may be returned under the Returns Policy. Delivery Fees are non-refundable for change-of-mind returns. Refund processing times depend on your financial institution.

Promotions, Discounts, and Gift Vouchers

  • Promotional Codes must be applied at the time of Order.
  • Gift Vouchers expire 12 months from the issue date and are not redeemable for cash.
  • Personal information provided during Orders is handled under dref’s Privacy Policy.
  • Discount codes cannot be used in conjunction with sale items, other discounted items, or other promotional offers unless expressly stated by dref. This restriction applies during sale campaigns, promotional periods, and clearance events.

Risk and Liability

Risk and title pass to you on delivery. Australian Consumer Law rights apply. dref may provide additional warranties. dref excludes all other implied terms to the fullest extent permitted by law. Liability is limited to the extent you contribute to loss or damage.

Competitions

By entering competitions, entrants accept terms. Competitions are not sponsored or endorsed by social networks.

Eligibility: Australian residents, 18+, or with guardian consent. Follow social media instructions for valid entry.

Prizes: As stated in the competition post; not redeemable for cash. Substitutions may occur.

Winner Selection: Based on creativity and originality. Winners notified via social media and must respond within 3 days.

The Promoter may verify entries, disqualify ineligible entrants, and is not liable for lost or miscommunicated correspondence.
